Terms of Service

Welcome to PickleCue! These Terms of Service ("Terms") govern your use of the PickleCue mobile application ("App") and related services provided by PickleCue ("we," "our," or "us"). By using our App, you agree to these Terms. If you don't agree, please don't use the App.

1. Acceptance of Terms

By downloading, installing, or using PickleCue, you confirm that:

• You are at least 13 years old
• You have the legal capacity to enter into this agreement
• You will comply with these Terms and all applicable laws

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To use certain features of PickleCue, you must create an account. When you do:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Use of the Service

3.1 Permitted Uses

PickleCue is designed to help you:

• Find pickleball courts in your area
• Create and join pickup games
• Connect with other players
• Track your playing history and statistics
• Join leagues and tournaments
• Improve your skills through drills and tips

3.2 Prohibited Uses

You agree NOT to:

• Use the App for any illegal purpose
• Harass, threaten, or abuse other users
• Post false, misleading, or defamatory content
• Impersonate another person or entity
• Spam or send unsolicited promotional content
• Collect or harvest user data without consent
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App
• Use automated tools to access the service (bots, scrapers)
• Post content that is sexually explicit, violent, or promotes hate
• Violate any third-party rights (intellectual property, privacy)

4. User Content

4.1 Your Content

You retain ownership of content you post (reviews, photos, messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the service.

4.2 Content Guidelines

All user content must:

• Be accurate and truthful (especially court reviews)
• Respect the privacy of others
• Not infringe on intellectual property rights
• Comply with our Community Guidelines

4.3 Content Moderation

We reserve the right to remove any content that violates these Terms or is otherwise objectionable. We may also suspend or ban users who repeatedly post inappropriate content.

5. Court Information

PickleCue provides information about pickleball court locations gathered from public sources and user submissions. We make reasonable efforts to ensure accuracy, but:

• Court availability, hours, and fees may change
• Verify information directly with the court/facility
• We are not responsible for inaccurate court information
• Some courts may be on private property - respect access rules

6. Games and Meetups

PickleCue facilitates connections between players but does not supervise games or events. By participating in games organized through the App:

• You acknowledge inherent risks in physical activity
• You are responsible for your own safety and well-being
• You agree to behave respectfully toward other players
• You release PickleCue from liability for injuries or disputes

If you organize a game, you are responsible for ensuring the venue is appropriate and any necessary permissions are obtained.

7. Trust Score and Ratings

PickleCue uses a Trust Score system to encourage reliable behavior. Your Trust Score may be affected by:

• Showing up to games you've committed to
• Canceling in advance vs. no-showing
• Feedback from other players
• Verified account status

Attempting to manipulate ratings (fake reviews, coordinated voting) is prohibited and may result in account suspension.

8. Premium Features and Payments

Some features may require payment. If you purchase premium features:

• Payments are processed through Apple's App Store
• All purchases are subject to Apple's terms and refund policies
• Subscription renewals occur automatically unless cancelled
• Prices may change with reasonable notice

We are not responsible for payment processing issues handled by Apple.

9. Intellectual Property

PickleCue, including its design, features, and content (excluding user content), is owned by us and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or decompile the App
• Use our trademarks without permission
• Create derivative works based on our App

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission

We do not guarantee that you will find playing partners, that courts will be available, or that games will occur as scheduled.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKLECUE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Personal injury resulting from your use of the App
• Actions or content of other users
• Third-party services or links

Our total liability shall not exceed the amount you paid us in the twelve months preceding any claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless PickleCue and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your content or conduct
• Your participation in games or events

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be:

• Governed by the laws of the State of California
• Resolved through binding arbitration (not class action)
• Conducted in accordance with AAA Commercial Arbitration Rules

You waive your right to participate in class actions against us. Small claims court actions are permitted.

15. Termination

You may stop using PickleCue and delete your account at any time. We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or harass other users
• Fail to pay for premium services

Upon termination, your right to use the App ceases immediately. Sections that should survive termination (disclaimers, limitation of liability, etc.) will remain in effect.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance. If you disagree with changes, stop using the App and delete your account.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and PickleCue.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Failure to enforce any right does not waive future enforcement.
• Assignment: We may assign our rights; you may not assign yours without consent.
• Notices: We may send notices via email or in-app notifications.
